Phuket Co-Working Space & YouTube Studio

1. Introduction
These Terms and Conditions (“Agreement”) govern your use of the facilities and services provided by Phuket Co-Working Space & YouTube Studio (“PCWS”), located at Summit Tower, Phuket, Thailand. By using our services or becoming a member, you (“Member”) agree to abide by all terms outlined herein.

2. Membership Plans
PCWS offers the following membership packages:

  • Virtual Address Services: Provides a business address for company registration and mail forwarding purposes. This plan does not grant physical access to the premises outside of normal working hours. PCWS staff will not sign for or accept packages on behalf of members under this plan.

  • Nomad: Includes Virtual Address Services, a mailbox, and complimentary access to ground-floor hot desks during business hours.

  • Nomad Elite: Includes all Nomad benefits, plus Thai/English receptionist services, unlimited call handling, mail forwarding, document translation, and business address display.

  • Nomad VIP: Includes all Nomad Elite benefits plus a private desk, 24-hour facility access, daily refreshments, access to legal and accounting networks, and YouTube Studio access with complimentary studio hours.

  • Nomad Budget: Includes all Nomad benefits plus a private desk, 24-hour facility access, access to legal and accounting networks, and YouTube Studio access with complimentary studio hours.

3. Facility Usage

  • Access: Members may access designated areas based on their membership level.

  • Conduct: All members must maintain a respectful, professional demeanor and refrain from disruptive behavior.

  • Prohibited Items: Weapons, hazardous materials, illegal substances, and unauthorized animals are strictly prohibited.

4. Overnight Stay and Guests

  • No Residency: Sleeping or residing overnight at PCWS is strictly forbidden.

  • Guests: Guests are allowed only during regular hours (9:00 AM – 5:00 PM) unless prior written permission is obtained from management.

5. Member Key Tag Policy

  • Issuance: VIP members will receive a key tag granting after-hours access.

  • Lost Key Tag: A fee of 1,000 THB will be charged for lost or replaced tags.

6. After-Hours Access Notification
Members accessing the space outside of regular hours must notify the owner in advance via the PCWS group chat.

7. YouTube Studio Usage

  • Booking: All studio sessions must be reserved in advance. Nomad VIP members receive 2 complimentary hours per month; additional usage is billable.

  • Cancellations: Cancellations must be made at least 24 hours in advance to avoid charges.

  • Liability: Members are fully responsible for studio equipment during use and must cover any damages incurred.

8. Payment Terms

  • Billing: Monthly membership fees are payable in advance. Any additional services will be billed in arrears.

  • Late Payment: A 10% late fee will be applied to overdue payments.

  • Payment Methods: Accepted forms include credit/debit card and bank transfer.

9. Security Deposit
A refundable deposit equal to one month’s membership fee is required upon joining. It will cover damages or unpaid balances and is refundable upon termination, subject to any deductions.

10. Termination and Renewal

  • Member Termination: Requires 30 days’ written notice, effective from the end of the following calendar month.

  • PCWS Termination: PCWS may terminate any membership immediately in cases of non-payment or breach of terms.

  • Renewal: Memberships automatically renew monthly unless canceled in writing.

11. Liability, Damages, and Insurance

  • Personal Property: PCWS is not responsible for lost, stolen, or damaged personal belongings. Members are encouraged to obtain personal insurance.

  • Damages: Members are liable for any damage caused to PCWS property, equipment, or facilities beyond normal wear and tear.

12. Legal Compliance and Visa Requirements
Members must:

  • Comply with all applicable Thai laws and refrain from illegal activity on premises.

  • Hold valid work permits and visas required to conduct business activities in Thailand.

13. Confidentiality
Members must maintain confidentiality regarding sensitive or proprietary information encountered within PCWS.

14. Amendments
PCWS reserves the right to amend these Terms and Conditions with a 30-day notice period. Continued use of services after the effective date constitutes acceptance.

15. Governing Law
This Agreement is governed by the laws of the Kingdom of Thailand.

17. Business Activity Disclaimer
PCWS does not employ members, provide work opportunities, or act as a sponsor for any business activities conducted by members. Membership strictly entitles the Member to use designated workspace and facilities as per their plan.

  • No Representation: Members may not represent themselves as employees, agents, partners, or affiliates of PCWS.

  • Independent Responsibility: All business activities conducted within PCWS premises or using PCWS facilities are solely the responsibility of the Member.

  • Licenses & Permits: Members are solely responsible for obtaining and maintaining all required licenses, work permits, visas, and other legal authorisations necessary to operate their business in Thailand.

  • Indemnity: The Member agrees to indemnify and hold harmless PCWS, its owners, and staff from any claims, damages, losses, or legal actions arising from the Member’s business activities, representations, or non-compliance with laws.
